Marriage Certificate Translation for a USCIS Spousal Petition

The I-130 instructions ask for a copy of the marriage certificate and, if either spouse was married before, documents showing each prior marriage was legally terminated. Under the USCIS Policy Manual a marriage is recognized if it is valid in the place of celebration, and a civil marriage is one a civil authority has formally recognized, usually by issuing a certificate. So the document USCIS wants is the civil record, not the church or mosque paper, unless the country treats the religious record as the civil one. The I-130 instructions want the translator's printed name, signature, date and contact details on the certification.

What an officer reads on the translation. The date and place, both spouses' civil status at the time (single, divorced, widowed), the parents' names, and any annotation. A certificate that says one spouse was "divorced" sends the officer looking for the decree, so the divorce decree translation belongs in the same packet; where an earlier marriage ended in death, the death certificate translation. Marriage Certificate Translation for a Name Change

Social Security changes the name on a card against a marriage document that shows both the old and the new name, and it takes originals or agency-certified copies, never photocopies. The New York DMV lists a marriage certificate as proof of a name change and requires a certified English translation of foreign-language documents. The catch with foreign certificates is that many do not state a new name at all: a Mexican or Brazilian woman keeps her surnames, and a Spanish-language certificate lists both spouses under their birth names. The translation cannot invent a married name. It renders the record exactly and explains the naming convention in a translator's note.

Marriage Certificate Translation for Divorce and Family Court

A divorce petition in a US family court starts with proof of the marriage, and a foreign certificate carries terms the court will read closely. A Mexican acta de matrimonio states whether the couple married under sociedad conyugal (community property) or separación de bienes, because Mexican law requires the choice to be recorded in the act. A Brazilian certidão de casamento states the regime de bens, with partial community as the default, and later averbações in the margin record a separation, a divorce or a change of regime. We translate the regime as named and add a note on what it means rather than substituting a US term that does not match. Probate courts read the same certificate to establish a surviving spouse; for litigation it can be worded as a declaration (certified translation).

Religious vs Civil Marriage Certificates

Whether the church, temple or nikah record counts depends on the country.

India. Under the Hindu Marriage Act, 1955, registration under section 8 is not compulsory and an unregistered Hindu marriage is still valid; interfaith couples use the Special Marriage Act, 1954. USCIS accepts a registrar's certificate and, where none exists, sworn affidavits from relatives who attended. Pakistan. The nikah nama is a handwritten Urdu contract; the Union Council registers it and issues a computerized certificate through NADRA's system, in Urdu and English. Filings usually need both, with the dower and conditions columns translated in full (Urdu translation). Philippines. A church wedding is registered with the local civil registrar, and the record that counts is the PSA Certificate of Marriage. Dominican Republic. Civil or religious ceremony, US immigration wants the act from the Junta Central Electoral's civil registry. China. The Civil Affairs Bureau issues each spouse a red marriage booklet, and a notary public office produces a notarial certificate with its own English, which we check against the Chinese (Chinese translation).

Maiden Names and Other Marriage Certificate Translation Problems

  • Maiden names. Spanish and Portuguese records list a woman under her birth surnames for life; Russian and Korean records handle the married name differently again. We keep the names as the record has them, spell them to the passport, and explain the convention in a note.
  • Margin annotations. In Mexico a divorce is entered as a marginal note on the marriage act; in Brazil it is an averbação. A translation without the margin shows a marriage that, on paper, still exists.
  • Property regimes. Sociedad conyugal, comunhão parcial, separation of property: translated as named, with a note, never replaced by the nearest US phrase.
  • Dates in words, witnesses and officiants. All rendered, because twelve lines on the original and seven on the translation is the definition of incomplete.

We had a religious wedding but no civil registration. Can you translate the religious certificate for USCIS?
We can translate it, but whether USCIS accepts it depends on the country. USCIS recognizes a marriage valid where it was celebrated and looks for a civil authority's record. In India an unregistered Hindu marriage is valid and secondary evidence is accepted; in Mexico or the Dominican Republic the civil act is what counts. Ask your attorney which document to file.
The certificate does not show my married name. How do I prove the name change?
Many countries do not record a new surname at marriage. We translate the certificate exactly and add a note explaining the naming convention. Social Security and the DMV decide what they accept; some applicants pair the certificate with a later passport issued in the married name.
