A bank will not release an account, an insurer will not pay, and a court will not open an estate without the document. Death Certificate Translation for USCIS Widow Petitions
The widow or widower of a US citizen can self-petition on Form I-360, and USCIS requires the petition within two years of the spouse's death. The checklist of initial evidence asks for the marriage certificate, proof that any earlier marriages of either spouse were terminated, evidence of the late spouse's citizenship, and a copy of the death certificate. If the spouse died abroad, that certificate needs a full certified translation under 8 CFR 103.2(b)(3). A death certificate also appears in ordinary I-130 spousal petitions whenever an earlier marriage of the petitioner or beneficiary ended in death rather than divorce, since the instructions ask for documents showing each prior marriage was legally terminated.
What the officer reads. The full name of the deceased as spelled on the certificate, the date and place of death, the marital status and surviving spouse if the form records them, and the issuing registry. Names are matched against the marriage certificate, so we spell them consistently across the packet and note any variant on the original. A surviving spouse, ex-spouse or dependent child claiming survivor benefits must prove the death. SSA's operations manual lists the death certificate first among its preferred evidence, followed by the funeral director's statement, and it does not accept an obituary as proof. For a death outside the United States the manual prefers a US Consular Report of Death Abroad where one exists; those are issued only for US citizens, so for a foreign national who died at home the local certificate is all there is. SSA's procedures have the claims office send foreign-language documents to its own translators, so a certified translation you bring is not strictly required but tends to shorten a claim that is already slow. Bring the original or a registry-certified copy; SSA does not take plain photocopies.
Death Certificate Translation for Probate, Estates and Insurance
Outside immigration, the death certificate is the key that opens everything else. A probate or surrogate's court needs it to admit a will or appoint an administrator; a bank or pension plan needs it to release an account; a life insurer needs it before it pays. When the death happened abroad, each office receives a foreign certificate and a translation, and each reads it for something different: the court for the domicile and date of death, the insurer for the cause and manner, the bank for the exact name. The State Department itself warns that a local foreign death certificate, written in the local language, is often not accepted in the United States for insurance and estate purposes without more. Two documents are easy to confuse. The medical certificate of death is signed by a physician and states the cause; the civil death certificate is issued by the registry on the strength of it and is what courts and agencies want. Send both if you have both.
Cause of Death and Other Death Certificate Translation Problems
- The cause of death. Written by a physician in clinical shorthand, often as a chain of conditions with intervals, sometimes with an ICD code. A general translator guesses; a medical translator renders it exactly, and for an insurance claim the difference between an accident and an illness is the claim.
- The informant. The person who reported the death, often a relative, sometimes the hospital. Courts read this line to see who was present; it is rendered in full.
- Names and dates. The deceased's name is spelled to match the passport or the marriage certificate, with the original spelling noted.
- Religious and funeral records. A burial certificate from a church or a funeral home statement is not the civil record. We translate it when a client needs it, and say plainly on the certificate what the document is.
